Terms and Conditions of Elyvora

1. Scope and seller

1.1 These Terms and Conditions apply to all orders placed by consumers via our online shop at elyvora.com.

1.2 Your contractual partner is: Erika Chechel, sole proprietor, trading as Elyvora, Höfer Weg 22A, 61184 Karben, Germany, email: elyvora.info@gmail.com (“we”, “us”). Further details can be found in our Legal Notice.

1.3 A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

2. Conclusion of contract

2.1 The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.

2.2 Ordering process: You add the desired products to your cart, go to checkout, enter your contact, delivery and payment details and choose a shipping method. Before submitting your order, you can review all details on the summary page and correct any input errors using the usual keyboard and mouse functions or the “back” links. By clicking the final order button (e.g. “Pay now” / “Complete order”), you submit a binding offer to purchase the products in your cart.

2.3 The contract is concluded when we accept your offer by sending an order confirmation by email, which is usually sent immediately after your order has been placed.

2.4 The contract languages are English and German.

2.5 We store the text of the contract. You will receive your order details and these Terms and Conditions by email with the order confirmation. The Terms and Conditions can also be viewed at any time on this page.

3. Prices and shipping costs

3.1 All prices are final prices. As a small business within the meaning of § 19 UStG (German VAT Act), we do not charge VAT and therefore do not show it separately.

3.2 Shipping costs are added to the product prices. You can find the shipping costs in our Shipping Policy; they are also shown in your cart and at checkout before you place your order.

4. Payment

4.1 The payment methods available are shown at checkout and currently include credit and debit cards, Shop Pay and PayPal, as well as further methods offered via Shopify Payments.

4.2 The purchase price is due immediately upon conclusion of the contract. Payment is processed by the respective payment service provider.

5. Delivery

5.1 We deliver to Germany, France, Italy, the Netherlands, Poland and Spain. Delivery times and conditions can be found in our Shipping Policy and on the respective product page.

5.2 If a product is unexpectedly not available through no fault of our own, we will inform you without undue delay and refund any payments already made without undue delay.

6. Retention of title

The goods remain our property until full payment has been made.

7. Right of withdrawal

As a consumer, you have a statutory right of withdrawal. Details can be found in our Cancellation / Refund Policy, including the model withdrawal form. You can also use the “Withdraw contract” button at the bottom of our website.

8. Warranty (statutory rights in case of defects)

8.1 The statutory warranty rights apply.

8.2 If goods are delivered with obvious transport damage, please report this to the delivery company and contact us as soon as possible. Failure to do so has no effect on your statutory rights; it simply helps us to assert our own claims against the carrier.

9. Liability

9.1 We are liable without limitation for damages resulting from injury to life, body or health, for damages caused intentionally or through gross negligence, and under the German Product Liability Act.

9.2 In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.

9.3 The above limitations of liability do not apply to the statutory warranty rights.

11. Dispute resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and have your habitual residence in another EU country, this choice of law does not deprive you of the protection of the mandatory consumer protection provisions of the country in which you have your habitual residence.

13. Product information, materials and skin compatibility

13.1 We do not manufacture our jewellery ourselves. Information on materials, plating and composition (e.g. stainless steel, gold plating, nickel-free) is based on the specifications provided by our manufacturers and suppliers. We carefully check this information for plausibility and pass it on to the best of our knowledge; we do not carry out our own laboratory tests.

13.2 Jewellery is worn directly on the skin. Even when the materials correspond to the product description, individual skin reactions (e.g. redness, itching or allergic reactions) cannot be ruled out, as skin tolerance varies from person to person and can be influenced by sweat, cosmetics, perfume or water. We therefore cannot guarantee that a product will be tolerated by every person.

13.3 If you have sensitive skin or known allergies (e.g. to nickel), we recommend wearing new jewellery for a short time first to test how your skin reacts. If irritation occurs, please remove the jewellery immediately and consult a doctor if necessary. Please also note our care instructions, where provided.

13.4 Your statutory warranty rights (section 8) and your right of withdrawal (section 7) remain unaffected. If a product does not correspond to the stated material, you are entitled to your statutory rights.
